This article examines the potential conflict between the right of the provinces to determine property rights, including the equitable right of rectification, and the federal government''s right to enact retroactive tax legislation. It poses a hypothetical question: Does rectification provide the appropriate remedy for the "unfairness" of retroactive legislation to taxpayers who intend and plan their transactions to minimize or avoid tax? The article reviews the trend toward the judicial broadening of rectification remedies in tax cases, as well as perspectives on reliance on the rule of law and transaction costs to determine if and when rectification would be appropriate. The authors conclude that, in certain circumstances, a provincial court could and should rectify a tax plan to counter the effects of a retroactive tax that does not target abusive tax planning, such as Quebec''s proposed (and subsequently withdrawn) tax increase aimed at high income earners.Cet article examine le conflit potentiel entre le droit des provinces de déterminer les droits de propriété, y compris le droit de rectification en equity, et le droit du gouvernement fédéral de promulguer une législation fiscale avec effet rétroactif. A Case Study of Instructors' Cultivation of Creative Thinking in an Adult Learning Environment
The world is changing at a frenetic pace. Current creativity research and literature reveals how important it is for adults to live and work in environments conducive to creative learning and thinking. In education, we know that instructors influence the learning environment significantly, but we do not have a clear understanding of how instructors cultivate a climate for creative learning and thinking for adult learners. The purpose of this research was to understand how instructors cultivate a climate for creative learning and thinking for adult learners. This qualitative case study explored the experiences of a small group of instructors qualified to teach the Red Team Member Course, a unique four-week course that is part of the Red Teaming Education Program conducted by the Department of the Army. Three instructors volunteered from this group using convenient sampling. Four semi-structured interviews and three classroom observations were conducted with each instructor. Data from interviews, observations, course documents, and instructor artifacts were analyzed for emerging concepts, patterns, and themes using the theoretical framework of the investment theory of creativity. Results emerging from the findings confirm evidence of the six creativity constructs of the investment theory of creativity exists in the learning environments of the Red Team Member Course instructors. The convergence of the six creativity constructs, personality, motivation, knowledge, intellectual abilities, environment, and thinking skills, provides evidence of how instructors cultivate a climate for creative learning and thinking for adult learners in this unique learning environment. These findings have implications for professional development and training for adult educators and the learning experiences for adult learners.

The Connection Between Culture and Wellness for Indigenous Social Workers
Reflecting on my own experience as an Indigenous social worker, and a thorough literature review of mostly other Indigenous researchers, I addressed the following questions: What can wellness look like for Indigenous social workers? Does connection to culture contribute to wellness for Indigenous social workers practicing from an Indigenous way of being? And does this connection to culture impact my approach to practice and how? By exploring the literature, current policy and legislation, and social work practice in this province, I will discuss how I navigate my work and how I ensure that my practice continues to be grounded in traditional ways of being. In addition, recent shifts in policy, legislation and practice, urge us to practice in a way that honours traditional systems of decision-making, planning and caring for children within child welfare in BC. Given this, this research is timely. I will explore cultural and permanency planning for children and youth in care and how my own experience plays a vital role in how I approach this area of practice. I will discuss the integral role of culture in my life and how it keeps me grounded to continue walking alongside the Indigenous community in a good way. Ultimately, though, the foundation of this research is centered around wellness. Wellness for Indigenous social workers directly impacts the work we do, how we approach children and families, and our ability to continue doing the work in a good way.
