Yet experts consistently rate childcare quality in the United States as mediocre at best. Why the disconnect? This Article argues that behavioral market failure is an important piece of the puzzle. Standard economic theory assumes parents are rational market actors, and even market failure theory cannot account for their imperfect rationality. But the paradox of poor childcare quality is not just market failure; it''s behavioral market failure. This diagnosis not only helps us understand the market''s dysfunction, but also enables us to think creatively about solutions. Armed with insights from behavioral economics, policymakers can identify, and in some cases capitalize on, parents'' behavioral anomalies, "nudging" them toward their desired childcare goals. Nudging parents is an important step toward building a better network of childcare to care for, nurture, and develop America''s children.

In the United States, family law norms and childcare policy have long reflected the view that childcare is a private, family matter. But childcare has crossed the private-public divide. In the absence of parents at home providing care, a substantial childcare market has emerged. And that market is failing. Our law, policy, and legal scholarship have yet to recognize and account for this new reality. This Article confronts the problem on its own terms, using economic analysis to diagnose our childcare crisis as a market failure, and makes the case for more active and explicit government intervention in the childcare market. Economic theory not only helps us understand why the market is failing, but also recommends specific law and policy levers-subsidies, regulation, and information-to mitigate market failure, enabling us to craft more responsive reforms. In the end, the market lens shifts our focus from what is private about caring for children to what is public about it. From this vantage point, the Article makes plain that our childcare market is too big-and too important-to fail.

Care and Capitalist Crisis in Anglophone Digital Landscapes
The term "mompreneur" has fallen into heavy usage in anglophone media since 2008. A mesh of two ideologically-loaded words, "mom" and "entrepreneur," the mompreneur is frequently defined by the functional meaning of these two words, but in this thesis I develop a more specific definition and study her as a discursive figure located at a particular intersection of identities. I argue that the mompreneur is a normative ideal in anglophone techno-utopian discourses who structures emergent political-economic relations. I find that she is overwhelmingly constructed as a high-achieving, flexible, creative, multi-tasking "supermom" who makes use of digital information and communication technologies to run a business from home while maximizing quality time with her (biological) children. I ask, what does the mompreneur''s idealized lifestyle and its complementary narratives tell us about the reproduction of white supremacy, heteropatriarchy and capitalism in a colorblind, postfeminist techno-optimist context? What can she tell us about the governance of care amidst economic relations increasingly mediated through digital technology? I take the discourse of mompreneurship as a case study by which to analyze the production of gendered and entrepreneurial subjectivities in relation to capitalist crisis. I find that the figure of the "mompreneur" emerges in her particular, anglophone political-economic context to reinforce the privatization and feminization of care work, to help construct a social consensus around technological advance and to absorb and appease surplus population.

Is the Family a Federal Question?
There has long been conflict over the relationship between the states and the federal system vis-a-vis the family. The traditional account of domestic relations describes family law as the exclusive domain of the states, and federal courts have credited this account in the "domestic relations exception." Although scholars have analyzed and critiqued the exception''s applicability to diversity jurisdiction, the intersection of federal question jurisdiction and this exception remains largely unexplored. This Article describes and critiques, on both instrumental and deeper normative terms, federal courts'' willingness to expand the "domestic relations exception" to include federal question cases. The Article proceeds in three parts. In Part I, I describe the emerging trend in federal courts of avoiding decision on federal questions implicating the family, either by expanding the domestic relations exception, or by using other avoidance doctrines as proxies to accomplish the same result. I also explain how Supreme Court dicta in Elk Grove Independent School District v. Newdow has exacerbated this trend. In Part II, I assess critically how and why federal courts are avoiding these questions, considering the potential doctrinal and policy bases for an expansive exception, and evaluating its potential scope. I conclude that there is no principled doctrinal or policy basis for an expanded domestic relations exception that includes federal questions. Part III shifts to a more normative and theoretical perspective, evaluating whether federal courts should defer to the states when facing federal questions affecting the family. Here, I argue that there is instrumental and normative value in preserving a federal forum. I also argue that, because an expanded domestic relations exception would subordinate litigants, cause expressive harm, and potentially trigger negative cultural consequences, federal courts should resist expansion. The Article concludes with some reflections on the implications of my analysis and emphasizes the important role of federal courts in supporting, empowering, and protecting contemporary American families.
