The free movement of capital is one of the four fundamental freedoms ofthe European Union internal market. This thesis seeks to examine how the European Court of Justice has interpreted the grounds under which a Member State may derogate from the full free movement of capital within the European Union. These Treaty derogations are found within Article 65 TFEU and include: certain residence-based taxation measures; national rules concerned with preventing abuse of the financial system; public policy and public security measures; information gathered for statistical or administrative purposes. The argument put forward in this thesis is that the Court should adopt a "contextually sensitive" approach to interpreting these exceptions to the free movement of capital. The reason for this approach stems from the unique and distinctive characteristics of capital, which makes it a volatile and (potentially) dangerous factor of production. This, as a matter of necessity, requires the Court to be sympathetic to national measures which seek to restrict the free movement of capital. The thesis argues that the Court can (and should) adopt such a differentiated approach, whilst maintaining consistency and coherence within its more general internal market jurisprudence. Early on, the thesis identifies the proportionality review as the tool through which a flexible and context driven approach could be achieved. The thesis also demonstrates and explores the different factors (e.g. economic, political, pragmatic, international) that influence how the Court undertakes the interpretative task and how these may be used to ensure consistency amongst freedoms. The overall conclusion of the thesis is that not only is it possible (and desirable) for the Court to adopt a differential and context orientated approach to the exceptions, but that the Court is already doing this in a number of important areas (including restrictions on third country tax movements and in areas concerned with public policy).

Poetry. THE REDCOATS is a book of doubts. An elegy and celebration of those fragments of a specific American history always at risk of reduction to kitsch and irony. These poems attempt to manufacture a sense of identity from the contradictions of a self-consciously contemporary perception of these historical tropes, and the overwhelming sense of being ill-equipped to abide in those perceptions. Rather than applying a historical context to the contemporary, THE REDCOATS provides a contemporary context to the historic (in the manner, for example, of the painter Larry Rivers).This makes it perhaps a sad book, or a book with more dislocation than comfort, but with the ambition to find and occupy a space between, to at least temporarily balance the blind acceptance of a moral and nationalistic absolutism (which may also stand in here for a kind of New England spirituality) and a comic and ironic rejection of those mores in the face of contemporary life. THE REDCOATS recognizes a pressure to enjoy the spoils of our national mythology and the absurdity of anxiety in an age of easy antidote, modern medicine, and quotidian comfort. A history, however, not regarded with either pure rapture or dismissive disinterest but with an unsettling combination of both.

This work is devoted to comparing two integral bases for the integral cohomology of the Hilbert scheme of points in the projective plane. Let X be a smooth complex projective surface. One of the more interesting moduli spaces parameterizing objects associated with X is the Hilbert scheme of points, denoted X[superscript [n]], which parameterizes all 0-dimensional closed subschemes of length n in X.W. Wang, Z. Qin and W.P. Li used Heisenberg algebra operators to construct an integral basis of the integral cohomology of X[superscript [n]] whenever X is a smooth projective surface with vanishing odd Betti numbers. On the other hand, a work by G. Ellingsrud and S.A. Strømme gives a cellular decomposition of the Hilbert scheme of points on the projective plane. From this work, we have a second integral basis for the integral cohomology of X[superscript [n]] when X = P2. We compare the elements of these two bases and ultimately give the upper triangular transition matrix from one basis to the other.

There are three self-contained essays in this dissertation. In the first essay (Chapter 2 of the dissertation) I estimate various achievement models for math and reading using the nationally representative Early Childhood Longitudinal Study, Kindergarten Class (ECLS-K) dataset. An indicator for gifted program participation captures the impact of gifted programs, holding innate ability constant.

Poetry. DOWN WITH THE SHIP is Ryan Murphy''s first full-length collection of poetry. A staff member at the Academy of American Poets in New York, Murphy''s work echoes a few other poets who''ve haunted that fair city-names like Berrigan and Ceravolo come to mind-but this is no mere derivative exercise. With a fine ear for cadence and an eye for the odd and illuminating line break, Murphy gleans the U.S. cultural landscape for both detritus and diamonds in the rough, emerging with a unique post-millennial blend of torqued language and affecting (if also disembodied) confession. In this beat-up world we can bat clean-up for the L.A. Dodgers and find joy in "That same old feeling,/a pop song" and yet at once concur that we fight darker thoughts, that "It is wrong/to want to punt/the child that wails/in the night." A fine debut.
