The Success of Chapter 11

release date: Jan 01, 2009

Chapter 11

release date: Oct 24, 2008
Chapter 11
The ambition of the Chapter 11 system is enormous. Failing businesses can file a petition in bankruptcy, give themselves some breathing room, and take a final chance to save their businesses. Large or small, desperately sliding into collaspe or merely in serious trouble, a company can attempt to reorganzie or, if necessary, can arrange a more orderly burial. This book is about that system... This is a small book that tours a large system, guided on the one hand by the statutory structure and on the other by how the system operates in practice. This book sacrifices coverage of every possible twist in favor of a more coherent overview that exposes some of the tensions, the contradictions, and the genius that comprise Chapter 11. Whatever else may be learned from this book, I hope these pages give a sense of just how interesting the world of business failure and rebirth can be - Elizabeth Warren.

The Fragile Middle Class

release date: Jul 01, 2006
The Fragile Middle Class
From 1997 to 2000, the number of Amer. families filing for federal bankruptcy annually exceeded one million. Those who file are members of the middle-class (MC) -- a group that has long provided stability & vitality for the Amer. economic system. Why are unprecedented numbers of Amer. encountering such serious financial trouble? The authors analyzed court records & demographic data on thousands of bankruptcy cases, as well as debtors'' own accounts of the reasons for their bankruptcies. For many MC Amer., financial stability is fragile -- almost any setback can be disastrous. The authors view the bankruptcy process in the light of changing cultural & economic factors & consider what this may signify for the future of a large, secure, & dynamic MC.

Jonathan Wright Plummer

release date: Jan 01, 2006
Jonathan Wright Plummer
The book about Jonathan Plummer comes out of my association with the Religious Society of Friends. This group attracted me because of their practice of silent group worship and a simple lifestyle. In this time of great national stress, the Quaker devotion to peace and their quiet service to mankind satisfies my sense that theirs is an appropriate response to the needs of our times. Jonathan Plummer was praised as one of the pioneers of the renaissance of the Society of Friends at the end of the 19th Century. He urged people to act on their faith, a venerated Quaker principle. He brought together seven Yearly Meetings from Illinois to New York and Philadelphia to devise ways to carry out Quaker testimonies. These included urging peaceful relations among men, giving aid and strength to those in prison, and helping working women, children and those needing education. The long-established Quaker opposition to the death penalty for convicted criminals was also on the agenda of the organization he founded, the Friends'' Union for Philanthropic Labor. The Union evolved into the Friends General Conference whose work continues today. Jonathan Plummer is an example of 19th Century Quaker devotion and service to his fellow man at a time of great social change in America.

Asking for it

release date: Jan 01, 2006
Asking for it
This thesis examines an abusive relationship I had that lasted three and a half years. I''ve outlined why I was vulnerable to such a relationship---my parents'' marriage experiencing serious trouble; a car wreck that temporarily put me in a wheelchair; the rejection of the boyfriend who caused the wreck; and an overall need for love and stability. Craig, the abusive boyfriend, was older, and initially charming and loving. He also came from a devout churchgoing family, which both intimidated and enthralled me because my own family did not attend church. I decided if I could just become a "good Christian woman," I could have a perfect life and marriage. At first Craig seemed a perfect mate, but then he gradually became very controlling, and ultimately verbally and emotionally abusive. I''ve attempted to show both why I stayed for so long, and why I eventually left our relationship.

Contracting Out of Bankruptcy

release date: Jan 01, 2006
Contracting Out of Bankruptcy
This article draws upon data from a large empirical study of business bankruptcy cases to cast serious doubt upon two of the fundamental premises required to support claims that bankruptcy law should be replaced by default procedures established by contract. A number of proposals have been made to privatize the bankruptcy process by contract. The proponents of these contractualist approaches assume that default structures bargained in the marketplace will reduce transaction costs and improve post-default outcomes. Although these proposals necessarily affect materially the interests of third parties, their proponents suggest devices that are claimed to make that process efficient and non-redistributive. One premise underlying a contractual approach is that third parties can adjust their prices and terms to account for the effects of the proposed bankruptcy contracts. Prior scholarship has cast doubt on this premise by identifying categories of involuntary and maladjusting creditors who could not make such adjustments. This article for the first time quantifies that critique, showing that in most business bankruptcies there are many such involuntary or maladjusting creditors. Second, contractual theories necessarily assume that many or most business bankruptcies involve relatively few claims, because numerous claims, especially small ones, would impose transaction costs that are substantial enough to make individual negotiation or even unilateral adjustment by each creditor impossible. In fact, the data reveal that the typical business bankruptcy case presents many claims that are too small to be adjusting. These data demonstrate that a contractualist system will likely produce substantial inefficiencies, including a redistribution of wealth to the parties to the proposed bankruptcy contracts. The data support the superiority of a model of bankruptcy law that provides a non-waivable, collective infrastructure for the resolution of a multiparty economic problem.

Secured Credit
''The systems approach we employ in this book looks at more than just law. Law is one of many elements that together constitute the secured credit system. As We Forgive Our Debtors

release date: Jan 01, 1999
As We Forgive Our Debtors
Bankruptcy in America is a booming business, with hundreds of thousands of ordinary Americans filing for bankruptcy each year. Is this dramatic growth a result of mushrooming debt or does it reflect a moral decline that permits the middle class to evade their debts? As We Forgive Our Debtors addresses these questions with hard empirical data drawn from bankruptcy court filings. The authors of this multidisciplinary study describe the law and the statistics in clear, nontechnical language, combining a thorough statistical description of the social and economic position of consumer bankrupts with human portraits of the debtors and creditors whose journeys have ended in bankruptcy court. Book jacket.
